Terms of Use

Last updated

These terms cover the Consten app and this website. Consten is made by Donkeyshin, LLC, referred to below as “I”. They are written to be read, not survived.

The trial

Consten’s editing features are free for 14 days, no payment details needed to start. Nothing is backed up during the trial. An account is optional, and subscribing offers you one rather than requiring it. Backup also needs sync on.

The trial counts from when the app was first installed under your account with the store you downloaded it from, so it follows you across your devices on that platform and cannot be restarted by deleting and reinstalling. It is not an introductory offer from the App Store or Google Play. If you subscribe, the subscription starts and is charged immediately rather than after a further free period.

The subscription

  • What it is: Consten, a monthly auto-renewing subscription.
  • Length: one month.
  • Price: shown in the store at checkout, in your currency, and billed through your store account. Family sharing covers the subscription where your store offers it. Each person still signs in with their own account to sync.
  • Renewal: it renews automatically unless you cancel at least 24 hours before the current period ends.
  • Charge: your store account is charged for the next period within 24 hours before the current one ends.
  • Managing it: cancel or change it any time in your store account’s subscription settings. Cancelling takes effect at the end of the period you have already paid for.

A subscription keeps Consten editable, meaning adding, editing, checking off, and skipping tasks, along with reminders, widgets, and Siri. You can also turn sync on, at no extra cost, to back your tasks up to your account and keep them in step across your devices and survive a lost phone.

Billing is handled entirely by the store you bought the subscription from. I cannot cancel or refund on your behalf, so refunds are requested from that store directly.

If your subscription ends

Consten becomes read-only. You keep everything you have made: it stays on your device, visible and intact, for as long as the app is installed. What stops is writing.

  • Nothing is hidden, locked away, or deleted. Read-only means read-only.
  • If sync was on, the server copy is kept for 12 months. Within that window, signing in on a new device and turning sync on restores your history, even though you are not currently subscribed. Both steps are needed, because a fresh install starts with sync off. After 12 months the server copy is deleted. The copy on your device is not.
  • The account is deleted at 12 months as well. I warn you by email 30 days before and again 7 days before. Those emails are a courtesy and not a guarantee, so one that bounces or lands in spam does not pause the deletion. Coming back after that means signing up again, which is the same few taps it was the first time.
  • Resubscribing restores writing immediately, and picks up where you left off.

Deleting your data or your account

Settings has two separate controls. Delete Tasks and Preferences removes the server copy and keeps your account and subscription. Delete Account removes the account itself, along with that server copy. Neither touches your device. Both are described at Delete your data or your account.

Deleting your data or your account does not cancel your subscription. That is bought through an app store, so it has to be cancelled there, in your store account’s subscription settings.

Acceptable use

Consten is a personal task tracker. Do not use it to break the law, and do not attempt to attack, overload, or reverse-engineer the service. I may suspend an account being used to do either.

The app is provided as it is

I work to keep Consten accurate and available, but I cannot promise it will be free of faults or never unavailable. Consten is not a medical, clinical, or safety device. Do not rely on it where a missed task has serious consequences.

Arrival and departure are worked out by iOS from your device’s position. They can be late, early, or missed. Do not rely on them where timing matters.

To the extent the law allows, the liability of Donkeyshin, LLC is limited to what you paid for the subscription in the twelve months before a claim. Nothing here limits liability that cannot legally be limited.

Your data

How your information is handled is set out in the Privacy Policy, which forms part of these terms.

Changes

These terms may change as the app does. The date above reflects the most recent substantive change, and anything material shows up in the app as well, not only here.

Language

I wrote these terms in English. A translation is there to help you read them, not to replace them. If a translation and the English version disagree, the English version is the one that applies.
